Terms of Service

By accessing or using the Infinity Auto Marketing platform, dashboard, Auto Lister Chrome extension, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a binding agreement between you (or the dealership or business you represent) and Infinity Auto Marketing ("Infinity Auto Marketing," "we," "us," or "our"). Infinity Auto Marketing is operated by Infinity Auto Marketing LLC.

The Service is offered on a subscription basis. By subscribing, you authorize Infinity Auto Marketing (through Stripe) to charge your payment method on a recurring monthly basis, automatically renewing each month on or near your subscription start date until you cancel.

• All subscriptions are billed monthly and renew automatically.
• Prices are displayed in U.S. dollars and are subject to change with notice.
• You are responsible for providing and maintaining accurate billing information.
• Failed payments may result in temporary suspension of Service access.

Infinity Auto Marketing subscriptions are billed in advance on a recurring monthly basis unless otherwise stated at checkout.

All subscription payments are final and non-refundable except where required by law. This includes partial-month use, unused time, setup work, dashboard preparation, or a customer decision not to use the service after signup.

You may cancel your subscription at any time. Cancellation stops future renewals. Unless otherwise stated, your access remains active through the end of the current paid billing period.

Canceling does not automatically refund prior payments or the current billing period.

To cancel, use the Manage Billing button in your account dashboard, or contact us at [email protected]. Cancellation requests are processed within one business day. You will receive a confirmation email when your subscription is set to cancel.

Billing questions must be submitted within 30 days of the charge. Contact us at [email protected] and we will review your case. This does not guarantee a refund.

Infinity Auto Marketing provides tools, data, rankings, and workflow guidance to help dealerships and sales representatives operate more efficiently on Facebook Marketplace. We make no guarantee, representation, or warranty regarding:

• The number of leads, inquiries, or sales you will generate
• Revenue increases, gross profit, or specific financial outcomes
• Vehicle sales volume or Facebook Marketplace performance results
• The accuracy, completeness, or timeliness of market data or inventory rankings
• Ad performance or the results of any paid advertising campaigns
• Uptime or uninterrupted availability of the Service

Results vary based on inventory, pricing, follow-up, market conditions, dealership process, and customer usage. Infinity Auto Marketing does not guarantee leads, sales, vehicle sales volume, gross profit, ad performance, or Facebook Marketplace results.

The Service is designed to assist users in posting and managing vehicle listings on Facebook Marketplace. You are solely responsible for:

• Complying with all applicable Facebook Marketplace and Meta platform policies, terms of service, and community standards
• Ensuring your Facebook account and Marketplace activity comply with Meta's rules, including policies regarding vehicle listings, boosted posts, and advertising
• Any actions taken through your Facebook account using the Auto Lister extension or any information provided by the Service

Infinity Auto Marketing is not affiliated with, endorsed by, or in any way officially connected to Meta Platforms, Inc. or Facebook Marketplace. Changes to Facebook Marketplace's platform, policies, or features may affect or limit the functionality of the Service, and we are not responsible for any such changes.

The Auto Lister Chrome extension is a browser tool that assists users in preparing and submitting vehicle listings to Facebook Marketplace. By using the extension, you acknowledge and agree that:

• You are solely responsible for every listing published using the extension, including the accuracy of vehicle descriptions, pricing, photos, and any claims made in the listing
• The extension is a tool — it does not independently publish listings without your action
• You will not use the extension to post misleading, fraudulent, or non-compliant listings
• Infinity Auto Marketing is not liable for any consequences arising from listings you publish, including account restrictions imposed by Meta

If you are using the Service on behalf of a dealership or other business entity, you represent that you have authority to bind that entity to these Terms. You and your dealership are solely responsible for:

• All vehicle pricing, descriptions, photos, and claims in any listing published using the Service
• Compliance with all applicable federal, state, and local laws and regulations governing the sale of motor vehicles, including advertising regulations, dealer licensing requirements, and consumer protection laws
• Ensuring your team uses the Service in accordance with these Terms
• Maintaining accurate and up-to-date inventory data uploaded to the Service

The Service integrates with or links to third-party services, including Stripe, Meta/Facebook, Google, Vercel, and Supabase. Your use of those services is governed by their respective terms of service and privacy policies. Infinity Auto Marketing is not responsible for the content, availability, or practices of any third-party services.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to reverse engineer, decompile, or extract source code from the Service
• Share account credentials with unauthorized users
• Attempt to gain unauthorized access to any part of the Service or its underlying infrastructure
• Use automated scripts to scrape, crawl, or otherwise extract data from the Service beyond normal usage
• Interfere with or disrupt the integrity or performance of the Service

All content, features, software, and functionality of the Service — including but not limited to the dashboard design, ranking system, vehicle scoring logic, and Auto Lister extension — are the exclusive property of Infinity Auto Marketing and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes during the term of your subscription. This license does not include the right to sublicense, sell, or redistribute any part of the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Market data, inventory rankings, pricing signals, and boost recommendations provided through the Service are for informational purposes only and do not constitute financial, legal, or professional advice.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, INFINITY AUTO MARKETING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES YOU PAID TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless Infinity Auto Marketing and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any vehicle listings or content you publish using the Service.

These Terms are governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Utah, and you consent to the personal jurisdiction of such courts.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or applicable law. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by canceling your subscription and contacting us to request account deletion.
